1. Scope
1.1. The business relationship between VEREX Tactical – Ing. Alexander Haslauer (hereinafter the “Seller”) and the customer (hereinafter the “Customer”) is governed exclusively by the following General Terms and Conditions in the version valid at the time of the order.
1.2. You can contact our customer service department with questions, complaints and claims Monday to Friday from 10:00 to 18:00 by telephone on +43 699 154 500 70 or by email at info@verex-tactical.com.
1.3. A consumer within the meaning of these Terms and Conditions is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business or independent professional activity (§ 13 BGB).
1.4. Any differing terms of the Customer are not recognised unless the Seller expressly agrees to their application.
2. Offers and service descriptions
The presentation of products in the online shop does not constitute a legally binding offer, but an invitation to place an order. Service descriptions in catalogues and on the Seller’s websites do not constitute an assurance or guarantee.
All offers are valid while stocks last, unless otherwise stated for the relevant product. Errors are otherwise reserved.
3. Ordering process and conclusion of the contract
3.1. The Customer may select products from the Seller’s range without obligation and add them to a shopping cart using the “Add to cart” button. The product selection can be changed, for example by removing items, within the cart. The Customer can then proceed to complete the ordering process using the “Proceed to checkout” button in the cart.
3.2. By clicking the “Order with obligation to pay” button, the Customer submits a binding offer to purchase the goods in the shopping cart. Before submitting the order, the Customer can view and change the details at any time, return to the cart using the browser’s “Back” function, or cancel the entire ordering process. Required information is marked with an asterisk (*).
3.3. The Seller then sends the Customer an automatic acknowledgement of receipt by email, listing the Customer’s order again and allowing the Customer to print it using the “Print” function (order confirmation). This automatic acknowledgement merely documents that the Seller has received the Customer’s order and does not constitute acceptance of the offer. The purchase contract is concluded only when the Seller dispatches or hands over the ordered product to the Customer, or confirms dispatch to the Customer by a second email, an express order acceptance or by sending the invoice.
3.4. In the case of advance payment, the contract is concluded when the bank details and payment request are provided. If payment has not reached the Seller within 10 calendar days after the order confirmation was sent, despite being due and despite a further request, the Seller withdraws from the contract. The order then becomes void and the Seller has no obligation to deliver. The order is thereby concluded without further consequences for the buyer or Seller. Items ordered with advance payment are therefore reserved for no more than 10 calendar days.
4. Prices and shipping costs
4.1. All prices stated on the Seller’s website include the applicable statutory VAT (20% under the Austrian VAT rate).
4.2. In addition to the stated prices, the Seller charges shipping costs for delivery. These shipping costs are clearly communicated to the buyer on a separate information page and during the ordering process.
5. Delivery and availability
5.1. Where advance payment has been agreed, delivery takes place after receipt of the invoice amount.
5.2. If delivery fails through the buyer’s fault despite a delivery attempt, the Seller may withdraw from the contract. Any payments already made will be refunded to the Customer without delay. Costs incurred in this connection may be charged to the Customer or deducted from the refund.
5.3. If the ordered product is unavailable because the Seller has not been supplied with it by its supplier through no fault of its own, the Seller may withdraw from the contract. In this case, the Seller will inform the Customer without delay and may propose delivery of a comparable product. If no comparable product is available, or the Customer does not wish to receive a comparable product, the Seller will promptly refund any payments already made by the Customer.
5.4. Customers are informed about delivery times and delivery restrictions (e.g. delivery limited to certain countries) on a separate information page or in the relevant product description.
If an item has sold out in the meantime but is expected to become available again in the foreseeable future, the Customer will be informed of the delay by email or telephone and may decide whether to withdraw from the contract or wait for the ordered goods to arrive.
6. Payment terms
6.1. During and before completion of the ordering process, the Customer may choose from the payment methods available. Customers are informed about the available payment methods on a separate information page or during the ordering process.
6.2. If payment by invoice is exceptionally possible and expressly agreed, payment must be made within 30 days of receipt of the goods and invoice. All other payment methods require advance payment without deduction.
6.3. Where third parties, such as PayPal, are commissioned to process payments, their General Terms and Conditions apply.
6.4. If the payment due date is specified by calendar date, the Customer is in default as soon as that date is missed. In this case, the Customer must pay statutory default interest.
6.5. The Customer’s obligation to pay default interest does not prevent the Seller from claiming further losses arising from the default.
6.6. The Customer is entitled to set off claims only if their counterclaims have been established by a final court decision or recognised by the Seller. The Customer may exercise a right of retention only insofar as the claims arise from the same contractual relationship.
7. Retention of title
The goods delivered remain the property of the Seller until payment has been made in full.
8. Statutory warranty and guarantees
8.1. Statutory warranty rights are governed by the applicable legal provisions.
8.2. Goods supplied by the Seller are covered by a guarantee only if one has been expressly given. Customers will be informed of the guarantee conditions before beginning the ordering process.
8.3. VEREX Tactical – Ing. Alexander Haslauer expressly accepts no liability for property damage caused by or arising from customisation work (e.g. breakage of a firearm component due to excessive material removal).
No recourse claims may be brought against either the manufacturer or VEREX Tactical – Ing. Alexander Haslauer in this respect, because any change to a firearm from the manufacturer’s original design or manufacture may affect its reliability and may, in some circumstances, render the firearm unusable after the work has been carried out.
9. Liability
9.1. Without prejudice to other statutory requirements for claims, the following exclusions and limitations apply to the Seller’s liability for damages.
9.2. The Seller’s liability is unlimited insofar as the cause of the damage is based on intent or gross negligence.
9.3. The Seller is also liable for a slightly negligent breach of essential obligations whose breach jeopardises the purpose of the contract, or of obligations whose fulfilment is necessary for proper performance of the contract and on whose observance the Customer regularly relies. In this case, however, the Seller is liable only for foreseeable damage typical of the contract. The Seller is not liable for a slightly negligent breach of obligations other than those specified in the preceding sentences.
9.4. Where the Seller’s liability is excluded or limited, this also applies to the personal liability of employees, representatives and agents engaged in performing the contract.
9.5. To ensure safety after material-removing work or heat treatment on highly stressed firearm parts (barrel, slide, etc.), re-proofing is carried out at the Vienna Proof House in accordance with all CIP standards and the provisions of the Austrian Proofing Act in its currently valid version.
VEREX Tactical – Ing. Alexander Haslauer accepts no liability for the safety of continued firearm operation after the work described above and cannot be held liable for damages in the event of a loss.
It is the responsibility of the Vienna Proof House to determine whether the firearm or firearms customised at the Customer’s request remain safe for continued operation.
In the event of damage, recourse claims may at most be brought against the Vienna Proof House.
VEREX Tactical – Ing. Alexander Haslauer expressly accepts NO liability for property damage or personal injury caused by or arising from the work (e.g. breakage of a firearm component due to excessive material removal).
If VEREX Tactical – Ing. Alexander Haslauer can identify or assess before beginning the work that the modifications requested by the Customer could present a risk, the Customer will be informed and, where necessary, the proof house will be consulted in advance.
VEREX Tactical – Ing. Alexander Haslauer reserves the right to refuse orders if a risk to the safe operation of a firearm is identifiable in advance and the Customer is unwilling to change the requested modifications despite this warning.
10. Storage of the contract text
10.1. Before submitting the order to the Seller, the Customer can print the contract text using the browser’s print function at the final stage of the ordering process.
10.2. The Seller also sends the Customer an order confirmation containing all order details to the email address provided. If you have registered in our shop, you can view your orders in your profile area. We also store the contract text but do not make it accessible online.
11. Final provisions
11.1. The place of jurisdiction and place of performance is the Seller’s registered place of business.
11.2. The language of the contract is German.
11.3. European Commission online dispute resolution (ODR) platform for consumers: http://ec.europa.eu/consumers/odr/. We are neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration board.
